Child Custody and parenting time

In most custody battles there are three issues that come up: Physical Custody, Legal Custody, and Parenting time.

There are two types of Custody: Physical Custody and Legal Custody.

Physical Custody is based on where the child primarily lives and how much time is spent between the two parents. The court will order either Sole Physical Custody to one parent or Joint Physical Custody to both parents.

Legal Custody involves the decision making process on items such as religion, education, activities, and medical care. The court will either order Sole Legal custody or Joint Legal custody.

Parenting Time is the amount of time a parent spends with their children. Parenting time is often ordred as 50/50 or based on the Indiana Parenting Time Guidelines. The court has wide range of flexibility when ordering parenting and coming up with schedules that are in the best interest of the child.
