Annulments
While annulments are rare in our experience in Indiana, they are still possible to have. The petition for an annulment must state that you and your spouse have been residents of Indiana for at least six months, and that you've also been a resident of the county where you are filing in for at least three months.
ANNULMENT vs. DIVORCE
How is an annulment different than a divorce? An annulment is different from a divorce because rather than ending a valid marriage, an annulment means there was no marriage in the first place.
One of the largest reaasons for annulment in Indiana is due to:
- Fraud - being lied to get you to agree to the marriage.
Other reasons a marriage may be void or voidable:
- Mental Incapcitation
- Mental Incompetence
- Age - one person not being 18 years of age. There are exceptions where a person under the age of 18 can marry
- Duress - the person was forced
- Incest
